Terms of Service

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms of Service:

• Account means a unique account created for You to access our Service or parts of our Service.
• Company (referred to as either "the Company", "We", "Us" or "Our") refers to RezSync Africa.
• Service refers to the RezSync website and platform for career advancement and job matching.
• User refers to the individual accessing or using the Service.
• Content refers to any text, graphics, images, audio, video, software, data compilations, and any other material that appears on or forms part of this Service.

To access certain features of our Service, you may be required to create an account. You are responsible for:

• Providing accurate, current, and complete information during registration
• Maintaining the security of your password and account
• Promptly updating your account information to keep it accurate and current
• All activities that occur under your account

You may not use another user's account without permission. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

You agree not to use the Service to:

• Upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use the Service for any commercial purpose without our express written consent
• Upload or transmit viruses, worms, or any code of a destructive nature
• Collect or harvest any personally identifiable information from the Service

The Service and its original content, features, and functionality are and will remain the exclusive property of RezSync Africa and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content for the purpose of providing the Service.

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time.

We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

We do not guarantee that the Service will be available at all times and may experience downtime for maintenance, updates, or technical issues.

Some features of our Service may require payment. If you choose to use paid features:

• You agree to pay all charges incurred by you or any users of your account
• Payment is due immediately upon purchase unless otherwise stated
• All fees are non-refundable unless explicitly stated otherwise
• We reserve the right to change our pricing at any time

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL REZSYNC AFRICA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us for the Service in the 12 months preceding the claim.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

These Terms shall be interpreted and governed by the laws of Kenya, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the Arbitration Association of Kenya, unless both parties agree to resolve the dispute in court.
